Terms and Conditions for Clinical Psychological Treatment (Psychological Therapy), Clinical Psychological Diagnostics, Counseling, and Psychological Coaching

1. § Duration and Units
   Psychological treatment (psychological therapy), counseling, and psychological coaching are agreed upon and billed in units. One unit consists of 50 minutes. The length of a psychological session is agreed upon online when scheduling an appointment, by phone, or on-site during the psychological session between the psychologist and the client. The invoice is calculated proportionally based on the pricing units listed under "Prices." The costs for clinical psychological diagnostics are determined individually and communicated to the client before the assessment.

2. § Cancellation of Appointments
   Cancellations and rescheduling are free of charge if made at least 24 hours before the agreed appointment. After this period, the full fee will be charged. For diagnostic appointments, the cancellation period is 48 hours; otherwise, a cancellation fee of €200 will be charged. If the client is more than 15 minutes late, the appointment is canceled, and the cancellation fee must be paid as stated above.

3. § Confidentiality
   As a clinical psychologist, I am subject to the confidentiality obligations of the Psychologists Act. I guarantee to keep all information obtained during psychological counseling, therapy, online counseling, or coaching strictly confidential and will not share it with third parties under any circumstances.

4. § Billing and Payment Terms
   Clinical psychological counseling and therapy are considered psychological treatments and are therefore exempt from VAT under §6 Abs. 1 Z 19 UStG. Billing is carried out via bank transfer. Invoices from Frederike Spath, MSc, are due within 7 days net, without any deductions, and are sent by email after the session. In case of late payment, interest of 10% per annum may be charged, and a payment reminder will be sent.

5. § Invoice
   The prices are net prices, i.e., excluding VAT.

6. § Client Responsibility
   Frederike Spath, MSc, points out that clients may experience heightened emotions during psychological therapy. The clinical psychologist advises and supports conscientiously and responsibly. Clients are responsible for ensuring they understand and implement the guidance provided. In case of misunderstandings, clients are encouraged to ask for clarification. No claims for damages, invoice reductions, or refunds can be made.

7. § Online Sessions
   Online therapy via video chat with Frederike Spath, MSc, is chargeable based on the pre-arranged appointment. No guarantees are provided for quality issues or connection interruptions caused by factors beyond Frederike Spath, MSc’s technical control.

8. § Technical Requirements
   You need up-to-date technology and internet access to use my services smoothly. I cannot guarantee complete protection against viruses or other technical risks and am not liable for uninterrupted or error-free access to my services. Using the services requires an internet connection and an appropriate, modern device with browser capabilities that support video chat functions. Significant data usage occurs when using these services, which may result in additional costs, particularly for mobile usage. Clients bear the costs and risks of internet data usage. Clients acknowledge that due to the technical nature of the internet, full protection against viruses, Trojans, spyware, etc., can never be guaranteed.

9. § Publications
   Content published in the form of professional articles is independently written by Frederike Spath, MSc. There is no guarantee of scientific accuracy or completeness of this content.

10. § Disputes
    Disputes arising from the therapy contract and the general terms and conditions should be resolved amicably. Clients are encouraged to submit written counter-statements, differing opinions, or complaints to the respective other party.

11. § Liability for Content
    The contents of my website have been created with the utmost care. However, I cannot guarantee the accuracy, completeness, or timeliness of the content.

12. § Jurisdiction
    Vienna is agreed upon as the place of jurisdiction for disputes that cannot be resolved consensually. By submitting your written or verbal order, you fully accept these terms and conditions. Deviations require written confirmation.

13. § Final Provisions
    Should individual provisions of the counseling contract or the general terms and conditions be invalid or unenforceable, or become so after the conclusion of the contract, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a provision that comes as close as possible to the economic intent of the invalid provision. Frederike Spath, MSc, reserves the right to change the terms and conditions at any time.
